Terms of Service

These terms govern The Command Track mentoring program ("the Program"). The Program is provided by Robert Jonczyk, Tiestestraße 19, 30171 Hannover, Germany, a sole proprietor ("I", "the Mentor"). Contact: contact@thecommandtrack.com.

The Program is 1:1 professional development mentoring for student pilots and early-career pilots. It focuses on non-technical skills: decision-making, communication, workload management, situational awareness and leadership. It runs alongside your flight training; it does not replace it.

You ("the Client") must be at least 18 years old to enroll. You accept these terms when you pay for the Program.

• Not flight instruction. I do not give flight or ground instruction within the meaning of FAA regulations. I do not issue endorsements, sign logbooks or recommend you for any practical test. Your CFI and your flight school remain responsible for your training.
• Not an operational authority. Nothing in the Program overrides FAA regulations, your aircraft's POH/AFM, your school's procedures or your CFI's instructions. You remain solely responsible for every decision you make as a pilot.
• Not affiliated. The Program is independent. It is not affiliated with, sponsored by or endorsed by any airline, flight school, cadet program or the FAA. Views expressed are my own.
• Not a placement service. I do not arrange jobs, interviews or cadet program admissions.
• Not psychological, medical, legal or financial advice. The Program is not therapy or mental health care. Personality questionnaires used in the Program are tools for self-reflection and development. They are not a clinical or psychological diagnosis.

Each paid month includes:

• One 1:1 session of up to 70 minutes by video call.
• A written debrief sheet after each session, recording what we covered, your action points and your progress over time.
• Asynchronous contact between sessions via email or iMessage. I reply within 48 hours. Announced absences (e.g. vacation) are excluded; I will tell you about them in advance.
• Program materials such as guides and worksheets, for your personal use, as they become available.
• A personality profile at the start of the Program, discussed with you in a session. It is a tool for self-reflection, not a diagnosis (see section 2).

Unused sessions do not roll over to later months unless I cancelled or rescheduled them (see section 6).

• Payments are processed by Stripe. I never see or store your full card details.
• All prices are in US dollars. Your bank may charge currency conversion or foreign transaction fees.
• You receive a receipt by email after every payment.
• Automatic renewal (Monthly plan): your plan renews every month at USD 250 until you cancel. You can cancel at any time by email to contact@thecommandtrack.com or in the customer portal linked in your receipt. I confirm every cancellation by email.

30-day money-back guarantee. If you are not satisfied, email me within 30 days of your first payment and I refund that payment in full, no questions asked. The guarantee applies once per Client, to the first payment only.

Monthly plan. You can cancel at any time. Cancellation takes effect at the end of the current paid month, and you keep access until then. Apart from the money-back guarantee, months already paid are not refunded.

Prepaid plan. You can end the prepaid plan at any time. Within 30 days of payment, the money-back guarantee applies and you get the full USD 650 back. After that, the prepaid discount applies only if you complete the full prepaid period. If you end early, each month already started is charged at the regular Monthly rate of USD 250, and I refund the rest: USD 400 if you end after the first month, USD 150 after the second. A month counts as started once its session has taken place or its agreed date has passed without notice from you. Prepaid sessions must be used within 4 months of payment, unless I cancelled or rescheduled them. The prepaid plan does not renew automatically; if you want to continue afterwards, you can switch to the Monthly plan.

Cancellation by me. I may end the Program with 30 days' notice, or immediately for serious cause (e.g. abusive conduct). If I end it early, I refund any prepaid amount for months not yet started.

Your statutory rights, including the right of withdrawal in section 9, are not affected.

• Sessions are scheduled by mutual agreement. Times are confirmed in writing with the time zone stated.
• Either side may reschedule with at least 24 hours' notice. The new session takes place within 14 days of the original date.
• My flight duty can change at short notice. If I have to reschedule, the session is always made up; it is never forfeited.
• If you miss a session without notice, or join more than 15 minutes late without notice, the session counts as held.

Recording. I record a session only if every participant agrees at the start of that session. You can say no at any time without any effect on the Program. Recordings are used only for your debrief and to improve my mentoring. They are never published or shared. They are stored in Apple iCloud with end-to-end encryption (Advanced Data Protection), so Apple cannot access their content, and deleted after 6 months, or earlier on request. You may not record a session without my consent.

Confidentiality. I treat everything you share as confidential. The only exceptions are when you agree otherwise or the law requires disclosure. I will never name you or use your story publicly without your written consent.

Program materials. Worksheets, guides and debrief sheets are for your personal use. Please do not redistribute them.

Personal data. How I process your data is explained in the Privacy Policy.

No guaranteed outcomes. The Program aims to build habits and skills. I do not guarantee any result: no checkride pass, rating, job offer, interview invitation or cadet program acceptance. Your progress depends on your own effort and on factors outside my control.

Liability. I am fully liable for damage caused intentionally or through gross negligence, and for injury to life, body or health. For slight negligence I am liable only if I breach an essential contractual obligation, and then only for typical, foreseeable damage. Any other liability for slight negligence is excluded. Mandatory statutory liability remains unaffected.

If you are a consumer, you have the following statutory right of withdrawal. The 30-day money-back guarantee in section 5 applies in addition to it.

Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract is concluded. To exercise it, inform me (Robert Jonczyk, Tiestestraße 19, 30171 Hannover, Germany, contact@thecommandtrack.com) of your decision by a clear statement, e.g. an email. You may use the model form below, but you do not have to. Sending your notice before the period expires is enough.

Effects of withdrawal. If you withdraw, I refund all payments received from you without undue delay, and no later than 14 days after I receive your notice. I use the same means of payment you used, unless we expressly agree otherwise; you will not be charged any fees for the refund. If you asked for the services to begin during the withdrawal period, you pay an amount proportionate to the services provided until you told me of your withdrawal.

Early start. By booking your first session within 14 days of enrollment, you expressly ask me to begin the services before the withdrawal period ends. Your right of withdrawal expires once the contract has been fully performed at your express request.

Model withdrawal form

• Governing law. These terms are governed by German law. If you are a consumer, this choice of law does not deprive you of the protection of mandatory consumer law in your country or state of residence.
• Dispute resolution. I am neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
• Changes. I may update these terms for future enrollments. Changes to an ongoing Monthly plan take effect only after 30 days' notice by email; you may cancel before they apply.
• Severability. If any provision is invalid, the rest of these terms remain in effect.
• Language. These terms are provided in English.
